Delaware doc fees: no cap, and what buyers actually pay
What Delaware allows
- Delaware does not cap the doc fee. Dealers set it themselves, and there is no legal ceiling to point at.
- Buyers here commonly report around $697.00. That is a market figure drawn from reported deals, not a government number — treat it as a reference point for what is normal, not as a limit.
- The rule: No cap or disclosure statute; bill of sale itemizes fees (21 Del. C. 6305(8)). The 5.25% state document fee (30 Del. C. 3002) is a tax, not the dealer fee. Benchmark: CarEdge average, Oct 2026..
Is it taxed, and is it negotiable?
- The doc fee is NOT taxed in Delaware — you pay the fee, but no tax on top of it.
- With no cap in play, the doc fee is simply part of the total you are negotiating. What matters is the out-the-door number, not which line the money sits on.
What's specific to Delaware
- Delaware has no sales tax. When a car is titled it charges a document fee instead: 5.25% of the purchase price, paid to the DMV, the same everywhere in the state. It was 4.25% until October 1, 2025. It is not the dealer's own doc fee.
- The dealer's own processing fee is a separate charge. Delaware does not cap it and sets no required wording. The DMV tells dealers to list it as a service charge or administrative fee, apart from the state fees. The calculator does not figure the state document fee on it; the DMV does not say either way.

There is no cap. Buyers commonly report around $697.00.

Generally no — dealers charge it on every deal and will not remove the line. What you can do is negotiate the total out-the-door price, which is what actually determines your cost.
