What New York allows
- New York caps the documentary fee at $175.00. A dealer cannot charge more than that, and a figure above it is a billing error rather than a negotiating position.

Is it taxed, and is it negotiable?
- The doc fee is NOT taxed in New York — you pay the fee, but no tax on top of it.
- Because the cap is a legal ceiling rather than a required charge, a dealer is free to charge less. It is a smaller lever than the vehicle price, but it is not fixed by law at the maximum.

- Doc fees are capped at $175 and the cap is enforced — anything higher on your quote is over the legal cap.
- The doc fee itself is NOT subject to New York sales tax, as long as it's separately stated on your invoice and at or under the $175 DMV-permitted cap (standard practice).
