Ohio › Doc fee
Ohio doc fee cap: $398.00 and what it covers
What Ohio allows
- Ohio caps the documentary fee at $398.00. A dealer cannot charge more than that, and a figure above it is a billing error rather than a negotiating position.
- The cap is inflation-indexed, so it moves on a schedule rather than staying fixed. The figure above is the one currently in force.
- The rule: Ohio Rev. Code Sec. 4517.261(B)-(C) (lesser of CPI-adjusted amount or 10% of contract price, excl. tax/title/registration).
Is it taxed, and is it negotiable?
- The doc fee is NOT taxed in Ohio — you pay the fee, but no tax on top of it.
- Because the cap is a legal ceiling rather than a required charge, a dealer is free to charge less. It is a smaller lever than the vehicle price, but it is not fixed by law at the maximum.
What's specific to Ohio
- The dealer's documentary fee is NOT subject to sales tax in Ohio, and it is capped at the lesser of the current CPI-adjusted amount or 10% of the contract price.
