Mississippi › Doc fee
Mississippi doc fee cap: $425.00 and what it covers
What Mississippi allows
- Mississippi caps the documentary fee at $425.00. A dealer cannot charge more than that, and a figure above it is a billing error rather than a negotiating position.
- The rule: MMVC Reg. 8.1(B)(8) (30 Miss. Admin. Code Pt. 1301, R. 8.1), under Miss. Code 63-17-69: flat $425, not CPI-indexed. Amended 2017-01-21. Franchised dealers (63-17-55(b))..
Is it taxed, and is it negotiable?
- The doc fee is part of the taxable amount in Mississippi, so sales tax is calculated on it as well. A larger doc fee costs you more than the fee itself.
- Because the cap is a legal ceiling rather than a required charge, a dealer is free to charge less. It is a smaller lever than the vehicle price, but it is not fixed by law at the maximum.
- Taxed at 5%, a $425.00 doc fee really costs $446.25.
